Terms of Service

1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Every Vacay platform, including the PhotoTrip feature and all related services, websites, and applications (collectively, the “Service”), operated by Every Vacay LLC, a Virginia limited liability company (“Every Vacay,” “we,” “us,” or “our”).
By creating an account, accessing the Service, or clicking “I Agree,” you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
3. Account Registration
To access certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your account credentials confidential and not share your password with others.
- Notify us immediately at info@everyvacay.com if you suspect unauthorized access to your account.
- Be responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that contain false or misleading information, or that are used in violation of these Terms.
4. Use of the Service
4.1 License
Subject to these Terms, Every Vacay grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial family travel planning purposes.
4.2 Permitted Use
You may use the Service to:
- Upload travel inspiration photos to generate personalized family itineraries.
- Browse destination recommendations and activity suggestions.
- Access booking links to third-party travel platforms.
4.3 Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Upload photos or content that you do not own or have permission to use.
- Upload photos containing images of other people without their consent, particularly minors.
- Attempt to reverse engineer, decompile, or extract the source code or algorithms underlying the Service.
- Use automated tools (bots, scrapers, crawlers) to access or extract data from the Service.
- Upload content that is obscene, defamatory, harassing, or otherwise objectionable.
- Attempt to circumvent security features, rate limits, or access controls.
- Resell, sublicense, or otherwise commercialize the Service without our written consent.
5. Photos and User Content
5.1 Your Ownership
You retain ownership of any photos and content you upload to the Service (“User Content”). By uploading User Content, you grant Every Vacay a limited, non-exclusive, worldwide license to store, process, and analyze your User Content solely to provide the Service to you.
5.2 Your Responsibility
You are solely responsible for the User Content you upload. You represent and warrant that:
- You own the photos you upload or have the necessary rights and permissions to use them.
- Your User Content does not infringe any third-party intellectual property rights, privacy rights, or other rights.
- Your User Content complies with these Terms and all applicable laws.
5.3 AI Processing
By uploading photos, you consent to the processing of those photos by AI-powered image analysis tools to identify locations, themes, and aesthetics for itinerary generation purposes. See our Privacy Policy for details on how photos are handled.
5.4 Removal
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is otherwise inappropriate, without prior notice.
6. Itineraries and Recommendations
Itineraries, recommendations, and suggestions generated by the Service are produced by AI and are provided for informational and planning purposes only. You acknowledge that:
- AI-generated itineraries may contain errors, outdated information, or suggestions that are not suitable for your specific circumstances.
- Every Vacay does not guarantee the accuracy, completeness, or fitness of any generated itinerary.
- You are solely responsible for verifying information and making your own travel decisions, including confirming attraction hours, prices, availability, and suitability for your family.
7. Third-Party Booking Links and Affiliate Relationships
The Service contains links to third-party booking platforms, including but not limited to Booking.com, Viator, and GetYourGuide (“Third-Party Platforms”). You acknowledge that:
- Every Vacay may earn a referral commission when you complete a booking through these links. This does not affect your price.
- Your use of Third-Party Platforms is governed entirely by those platforms' own terms of service and privacy policies.
- Every Vacay is not a party to any transaction you complete on a Third-Party Platform and bears no responsibility for bookings, cancellations, refunds, or disputes arising from those transactions.
- Every Vacay does not endorse any specific Third-Party Platform or guarantee the quality of any travel product or service listed on those platforms.
8. Intellectual Property
8.1 Our Property
The Service, including its design, features, text, graphics, software, and underlying technology (excluding User Content), is owned by Every Vacay or its licensors and is protected by copyright, trademark, and other intellectual property laws. The “Every Vacay” name and logo are trademarks of Every Vacay LLC.
You may not use our trademarks, logos, or branding without our prior written consent.
8.2 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant Every Vacay a perpetual, irrevocable, royalty-free license to use that feedback without obligation or restriction.
9. Subscriptions and Payments
Subscription terms, pricing, and refund policy will be added here when finalized.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranty of any kind. To the maximum extent permitted by applicable law, Every Vacay disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Every Vacay does not warrant that:
- The Service will be uninterrupted, error-free, or secure.
- Any information provided through the Service is accurate, complete, or reliable.
- The Service will meet your specific requirements or expectations.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Every Vacay and its members, officers, employees, and agents will not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, or goodwill.
- Damages arising from your reliance on AI-generated itineraries or recommendations.
- Damages arising from third-party bookings or transactions.
- Any damage exceeding the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $50 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.
12. Indemnification
You agree to defend, indemnify, and hold harmless Every Vacay and its members, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
13. Termination
13.1 By You
You may stop using the Service and delete your account at any time through your account settings.
13.2 By Us
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we believe you have violated these Terms.
13.3 Effect of Termination
Upon termination, your license to use the Service ends immediately. Sections 5 (as to representations), 8, 10, 11, 12, 14, and 15 survive termination.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles. Any disputes arising from or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Virginia, and you consent to personal jurisdiction in those courts.
15. General
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Every Vacay regarding the Service and supersede any prior agreements.
- Severability: If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining Terms will remain in effect.
- No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
- Changes to Terms: We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page and notify you of material changes by email or through the Service. Continued use after changes take effect constitutes your acceptance of the updated Terms.
